The provisions of paragraphs 2 and 3 of Article 252-2 shall apply mutatis mutandis where the preceding two paragraphs are applicable; the provisions of paragraph 4 of the same article shall apply mutatis mutandis where paragraph 1 above is applicable.

Article 252-8.
The agreement jointly establishing a commission or commissioner or attached organ (hereinafter referred to as "joint organ" in this article) shall provide for the following matters:
1. The name of the joint organ;
2. The ordinary local public bodies which are party to such agreement;
3. The seat of the office of the joint organ;
4. Manner of selecting members of the joint organ and their status;
5. Except as provided above, relationship between the joint organ and the ordinary local public bodies concerned and other necessary matters relating to the joint organ.

Article 252-9.
As for selection of the members of a jointly established commission who would otherwise be elected by the assembly of the ordinary local public body, either one of the following methods shall be chosen in the agreement:
1. Election by the assembly of the ordinary local public body designated in the agreement; or
2. Election by the assemblies of all the ordinary local public bodies concerned from a common list of candidates nominated by mutual agreement of the chief executives concerned.

As for selection of the members of a commission or a commissioner or members of an attached organ established jointly who would otherwise be appointed by the chief executive with the consent of the assembly, either one of the following methods shall be chosen in the agreement:
1. Appointment by the chief executive of the ordinary local public body designated in the agreement with the consent of the assembly; or
2. Appointment by the chief executive of the ordinary local public body designated in the agreement from a common list of candidates nominated by mutual agreement of the chief executives concerned who shall obtain the consent of their respective assemblies to such nomination.
