In the case of the proviso of the preceding paragraph the national government agency shall give the notice specified under the same paragraph within a proper period of time after the performance of the said function.

 

Section II. Resolving Conflicts between the State and Ordinary Local Public Bodies; between Ordinary Local Public Bodies; and between Organs inside ah Ordinary Local Public Body

 

Subsection I. Commission for Resolving Conflicts Between the State and the Regions

 

(Establishment and Authority)

 

Article 250-7.

A Commission for Resolving Conflicts Between the State and the Regions (hereinafter in this Section referred to as the "Commission") shall be established in the Prime Minister's Office.

The Commission shall deal with matters in its authority in accordance with the stipulations of this Law, in relation to application for investigation regarding that involvement by the state or To, Do, Fu or Ken with regard to an ordinary local public body undertaken by a national government agency (hereinafter in this Section referred to as "involvement by the State").

 

(Organization)

 

Article 250-8.

The Commission shall be composed of five members.

Commissioners shall serve on a part-time basis. However, up to two commissioners among them may serve on a full-time basis.

 

(Members)

 

Article 250-9.

Commissioners shall be appointed from among persons of experience and learning by the Prime Minister with the approval of the Diet.

Three or more Commissioners may not belong to the same political party or other political organization simultaneously.

 

3.

When a Commissioner's term of office has expired or when there is a vacancy on the committee and the approval of the Diet cannot be obtained either because the Diet is adjourned or the House of Representatives has been dissolved, the Prime Minister may appoint a Commissioner from among persons qualified as stipulated in paragraph 1.
