Subsection IV Relationship with the Assembly

 

(Veto Power of the Chief Executive)

 

Article 176.

If the chief executive have any objection to a resolution of the assembly concerning enactment, amendment or abolition of a bylaw or concerning budget, he/she may, together with the statement of the reasons therefor, return it for reconsideration within ten days from the day of its receipt, except otherwise provided in this Law.

If after such reconsideration the same resolution as the previous one shall be passed by the assembly, such resolution shall become final.

 

3.

Such second resolution shall require the concurrence of more than two-thirds of the members present.

 

4.

If the chief executive find a resolution or election of the assembly ultra vires or contrary to law or rules of procedure, he/she shall, together with the statement of the reasons therefor, return it for reconsideration or call a reelection.

 

5.

The governor of To, Do, Fu or Ken or the mayor of a city, town or village may request inquiry of the minister of Home Affairs or the governor of To, Do, Fu or Ken respectively within 21 days from the day of such second resolution or election, if he/she find it still ultra vires or contrary to law or rules of procedure.

 

6.

If the Minister of Home Affairs or the governor of To, Do, Fu or Ken so requested find upon inquiry such resolution or election ultra vires or contrary to law or rules of procedure, he/she may annul it by adjudication.

 

7.

The assembly or its president may, if dissatisfied with such adjudication, file a suit with the court, within sixty days from the day of adjudication.

Article 177.

If the chief executive find impossible the execution of any resolution of the assembly relative to financial matters, he/she shall, together with the statement of the reasons therefor, return it for reconsideration.

 

2.

The same step as in the preceding paragraph shall be taken, if the assembly has voted down or cut down the following expenses:

1. Obligatory expenses under law, expenses duly charged by competent government agencies under law and other expenses obligatory upon the ordinary local public body;
