(Acting for Another Judge)
Article 8. When an urgent necessity is deemed by, the Director General of the High Marine Accidents Inquiry Agency may order a Judge of the High Marine Accidents Inquiry Agencyas well as a Local Marine Accidents Inquiry Agency to act as a Judge of another Local Marine Accidents Inquiry Agency in performance of his duties, and also may order a Judge of a Local Marine Accidents Inquiry Agency to act as a Judge of the High Marine Accidents Inquiry Agency in performance of his duties.
(Exclusion of Judge)
Article 9. The head of each Marine Accidents Inquiry Agency may exclude a Judge under his supervision from exercising his functions, when there are such reasons for challenge in accordance with the provisions otherwise provided.
(Refrainment from Exercising Judge's Functions)
Article 10. A Judge of the Marine Accidents Inquiry Agency may excuse himself from exercising his duties with permission of the head of the Marine Accidents Inquiry Agency (including the Chief of the Branch) to which he belongs, when there are such reasons for challenge in accordance with the provisions otherwise provided.
(Designation of a Commissioned Judge)
Article 11 . The designation of the Commissioned Judges shall be conducted by the head of each Marine Accidents Inquiry Agency, taking the nature of the case as well as the knowledge, experience, and the order of being on duties of the Commissioned Judge into consideration.
(Applicable Provisions)
Article 12. The provisions of Article 8 to 10 shall be applied mutatis mutandeis to the Commissioned Judges.
(Supplementary Judges and Commissioned Judges)
Article 13. The head of each Marine Accidents Inquiry Agency may, when the inquiry of a case is anticipated to take a long period of time, designate supplementary Judges or Commissioned Judges in addition to the full number of Judges or Commissioned Judges.
2. A supplementary Judge or a Commissioned Judge shall act in an inquiry case instead of what happened to a Judge or a Commissioner who should perform the same case.
