Chapter V. Procedure of Inquiry at the High Marine Accidents Inquiry Agency

Section 1. Inquiry Proceedings in the Second Instance

(Proceedings of Application for Second Instance)

Article 62. The application for the inquiry in the second instance shall be submitted in writing to the original Local Marine Accidents Inquiry Agency.

2. If the document mentioned in paragraph 1 is sent by post within seven (7) days, it shall be regarded as submitted within the period mentioned in Article 46, paragraph 3, of the Law.

(Validity of Application for the Second Instance)

Article 63. The validity of the application for the inquiry in the second instance shall has its influence on the whole of the case, and the Examinee and the Designated Persons Concerned in a Marine Accident.

(Forwarding of Documents concerned, Etc. When an Application is Made for the Second Instance)

Article 64. When the application for the inquiry in the second instance is made, the original Local Marine Accidents Inquiry Agency shall forward all the documents concerned and real evidences to the Commissioner of the Local Marine Accidents Inquiry Commissioner's Office located under the jurisdiction of the competent Local Marine Accidents Inquiry Agency, and then the Commissioner of such Local Marine Accidents Inquiry Commissioner's Office shall forward all the documents concerned and real evidences to the Commissioner of the Marine Accidents Inquiry Commissioner's Office.

2. The Commissioner of the Marine Accidents Inquiry Commissioner's Office shall submit all the documents concerned and real evidences to the High Marine Accidents Inquiry Agency.

3. When the application for the inquiry in the second instance is made, the original Local Marine Accidents Inquiry Agency shall promptly notify it to the Examinees, the Designated Persons Concerned in a Marine Accident and Commissioner who are not the applicant.
