(Extract of Protocol of Simple Inquiry)

Article 57. In the case of Article 52, the proviso of paragraph 1 an extract of the protocol of inquiry may be reserved to take place of a copy or an extract of the written judgement provided for in Articles 55 and 56.

Section 5. Ruling

(Ruling and Statement of Persons Concerned in the Inquiry)

Article 58. When a request is made on in court, a ruling shall be made after hearing the statement of persons concerned in the inquiry. In other cases, a ruling may be made without hearing the statement of persons concerned in the inquiry.

(Examination of Necessary Facts for a Ruling)

Article 59. A Marine Accidents Inquiry Agency may examine the facts to make a ruling if necessary.

2. A Marine Accidents Inquiry Agency may cause one of the Judges who belonges to it to conduct the examination mentioned in paragraph 1.

(Announcement of Ruling)

Article 60. Announcement of a ruling shall be made by pronouncement in the court, an original copy of the written ruling shall be served in the other case. However, an extract of the protocol of inquiry may be reserved to take the place of an original copy of a written ruling in the case of a simple inquiry.

(Applicable Provisions)

Article 61. In regard to a ruling, the provisions which is in connection with the judgement shall be applied mutatis mutandis therto in addition to the provisions prescribed in this section.
