(Formalities of Withdrawal of Application for Second Instance, Etc.)

Article 65. The Withdrawal of the application for the inquiry in the second instance shall be made by a writing to the High Marine Accidents Inquiry Agency. However it may be made by viva voce in the court.

2. When the withdrawal of the application mentioned in paragraph 1 is made by all of the applicants, the High Marine Accidents Inquiry Agency shall make a ruling to dismiss the application for the inquiry in the second instance.

(Citation of Facts and Evidences in Original Judgement)

Article 66. The facts and evidences which is shown on the base of the original judgement may be cited with regards to the judgements in the second instance.

(Applicable Provisions)

Article 67. As regards to the proceedings of inquiry in the High Marine Accidents Inquiry Agency, the provisions in connection with the proceedings of inquiry in the Local Marine Accidents Inquiry Agency shall be applied mutatis mutandis in addition to the provisions of this Chapter but Article 32 thereof.

Section 2. Raising of Objection

(Person of Raising Objection and Its Time)

Article 68. A person who is given a ruling in a Local Marine Accidents Inquiry Agency may raise objection against it to the High Marine Accidents Inquiry Agency.

2. Raising Objection may be done at any time.

(Proceedings of Raising Objection)

Article 69. The objection shall be submitted in writing to the original Local Marine Accidents Inquiry Agency.

2. When the reason of the raising objection is recognized, the original Local Marine Accidents Inquiry Agency may change the original ruling.

3. When the whole of the reason or the part of it in connection with the raising objections is not recognized, the original Local Marine Accidents Inquiry Agency shall forward the written objection to the High Marine Accidents Inquiry Agency within three (3) days from the date of receiving it.
