(Dismissal of Application by Illegal Proceedings)
Article 48. If the application for inquiry in the second instance is instituted in violation of rules, the High Marine Accidents Inquiry Agency shall dismiss such an application by means of a judgement.
(Return of case)
Article 49. If a Local Marine Accidents Inquiry Agency unlawfully dismiss an offer for the commencement of inquiry, the High Marine Accidents Inquiry Agency shall send the case back to the Local Marine Accidents Inquiry Agency by means of a judgement.
(Dismissal of Offer under Article 41)
Article 50. In case that a Local Marine Accidents Inquiry Agency fails to dismiss the offer for the commencement of inquiry falling under one of the each items of Article 41, the High Marine Accidents Inquiry Agency shall dismiss such an offer by means of a judgement.
(Judgement on Merits)
Article 51. The High Marine Accidents Inquiry Agency shall make a further judgement on merits except in case of Articles 48 to 50.
(Applicable Provisions)
Article 52. In regard to the inquiry of the High Marine Accidents Inquiry Agency, the provisions of Chapter V shall be applied mutatis mutandis except in the cases provided in this Chapter.
Chapter VII. Suit against Judgement Made by Marine Accidents Inquiry Agency
(Suit and Jurisdiction)
Article 53. A suit against the judgement made by the High Marine Accidents Inquiry Agency shall be placed exclusively under the jurisdiction of the Tokyo High Court.
2. A suit under paragraph 1 shall be instituted within thirty (30) days after the pronouncement of judgement.
3. The term under paragraph 2 shall be a peremptory term.
