(Announcement of Judgement)

Article 44. The announcement of a judgement shall be made by pronouncement in the court.

(Authorization to Order)

Article 45. Without being prescribed by this Law, necessary matters in connection with the proceedings of inquiry of a Local Marine Accidents Inquiry Agency shall be provided for by Order.

 

 

Chapter VI. Inquiry by the High Marine Accidents Inquiry Agency

(Application for Second Instance)

Article 46. A commissioner or an Examinee may make an application, as provided for by Order, to the High Marine Accidents Inquiry Agency for inquiry in the second instance against the judgement of a Local Marine Accidents Inquiry Agency.

2. A Counsellor may, in behalf of the Examinee, make an independent application as mentioned in paragraph 1. However, he shall not do so against the will expressed by the Examinee.

3. An application under paragraph 1 shall be made within seven (7) days after the pronouncement of judgement.

4. In case that a person who is authorized to make an application for inquiry in the second instance under the provisions of paragraph 1 or 2 fails to do so within the term prescribed in paragraph 3 due to the cause for which he is not responsible, he may make the said application within seven (7) days from the day when the said causeceased to exist.

(Withdrawal of Application for Second Instance)

Article 47. A commissioner or the Examinee may withdraw his application for inquiry in the second instance before the judgement shall be made.
