4. No suit shall be instituted against the judgement of a Local Marine Accidents Inquiry Agency.

(Defendant)

Article 54. In a suit under Article 53, paragraph 1, the Director General of the High Marine Accidents Inquiry Agency shall be the defendant.

Article 55. Deleted.

(Cancellation of Judgement)

Article 56. A court of justice shall cancel a judgement in case that the suit therefor is deemed sustainable.

2. In case of paragraph 1, the High Marine Accidents Inquiry Agency shall conduct an inquiry anew.

3. In regard to the case, the High Marine Accidents Inquiry Agency shall be bound by the conclusion by which the cancellation of a judgement was based on the trial of a Court of justice.

 

 

Chapter VIII. Execution of Judgement

(Execution of Judgement)

Article 57. A judgement shall be executed after it became final.

(Executioner of Judgement)

Article 58. The judgement of the High Marine Accidents Inquiry Agency shall be executed by a Commissioner of the Marine Accidents Inquiry Commissioner's Office, and the judgement of a Local Marine Accidents Inquiry Agency shall be executed by a Commissioner stationed at the seat of the competent Local Marine Accidents Inquiry Agency.

(Judgement and Execution of Revocation of License)

Article 59. When a judgement of revocation of license is made, a Commissioner shall confiscate the certificate of competency (including the approval under the Article 7, paragraph 1 of the Law for Ship's Officers which is applied mutatis mutandis and is replaced with words in the Article 23-2 paragraph 7 of the Law; hereinafter the same) or the pilot certificate, and shall forward the same to the competent authorities.
