SUMMARY
 
Executive summary:
 This document provides comments on the report of ESPH 10 (BLG 9/3) and a proposal to discuss whether (using ESPH 10/8, annex, appendix 6, as a basis) the .Guidelines for the Application of Amendments to the List of Substances in Annex II of MARPOL 73/78 and in the IBC Code and the BCH Code with Respect to Pollution Hazards, approved by the Marine Environment Protection Committee at its thirty-first session., are necessary even after the entry into force of the revised MARPOL Annex II.

1 The Marine Environment Protection Committee, at its fifty-first session, instructed the ESPH Working Group to review the Guidelines referred to in the 2002 Consolidated Edition of Annex II of MARPOL 73/78 (MEPC 51/22, paragraph 12.14 and MEPC 51/12/1). Japan has noted and welcomes the action taken and proposed to be taken by the ESPH Working Group in this regard (BLG 9/3, section 7 and annexes 6 and 8).
 
2 Japan further noted that the ESPH Working Group proposed to withdraw the Guidelines for the Application of Amendments to the List of Substances in Annex II of MARPOL 73/78 and the IBC and BCH Codes with Respect to Pollution Hazards on the grounds that these Guidelines served the purpose at the time they were developed but were now outdated (BLG 9/3, annex 6, paragraph 1.1).
 
3 These Guidelines are referred to in regulation 2.7 of the current MARPOL Annex II (though not in the corresponding regulation 4.1.1 of the revised MARPOL Annex II) and provide criteria for the Administration in delaying the application of amendments involving changes to the structure or equipment and fittings to existing ships and maximum periods for such period of grace.
 
4 In view of the number of up-gradings in ship-type requirement and the introduction of residue quantity requirements for Category Z substances in the revised MARPOL Annex II, the Guidelines may continue to be used by Administrations when Administrations relax the requirement, in particular:
 
.1 to grant ships a period of grace to those engaged in domestic or restricted trades; and
 
.2 in setting a 10 year maximum period of grace for the change of ship-type (structure requirement) and a 2 year period of grace for fitting an underwater discharge outlet and efficient stripping system (equipment or fittings requirements).
 
5 The Chairman of the ESPH Working Group had submitted a revised version of the above-mentioned Guidelines to ESPH 10 (ESPH 10/8, annex, appendix 6). Japan would like to discuss, using this document, whether or not the Guidelines should be retained even after the entry into force of the revised MARPOL Annex II on 1 January 2007.
