With the exception of cases in which it is deemed to be particularly necessary, for example when it is necessary to ensure urgently a precise handling of the Self-government functions in order to protect the lives, physical safety or property of the people, the state shall ensure that the Self-government functions of the ordinary local public body are handled without the involvement of the state or To, Do, Fu or Ken as prescribed in number 6 of item 1 of Article 245.

 

(Technical Advice and Recommendations, and Requests for the Submission of Data)

 

Article 245-4.

A Minister (as prescribed in paragraph 1 of Article 5 of The National Government Organization Law; the same being applicable hereinafter in this chapter, the following chapter and chapter 14), governor or other executive organs of the To, Do, Fu or Ken may, in respect of matters under their charge, give the ordinary local public body technical advice or recommendations considered pertinent to the management of the affairs of the ordinary local public body or other matters, and may request it to submit data necessary for the furnishing of the said technical advice or recommendations or information regarding the proper handling of its affairs.

A Minister may, in respect of matters under his or her charge, give necessary directions to the governor and other executive organs of the To, Do, Fu, or Ken relating to advice or recommendations to, or a request for the submission of data form, a city, town or village as prescribed in the preceding paragraph.

 

3.

The chief executive or other executive organs of an ordinary local public body may make a request to a Minister or the governor or other executive organs of the To, Do, Fu or Ken for technical advice or recommendation or for necessary information in relation to the management and execution of matters coming under their charge.

 

(Request for Rectification)

 

Article 245-5.

In the event that the handling of the Self-government functions of the To, Do, Fu or Ken is deemed to be in violation of legal stipulations, or is markedly inappropriate so as to clearly impair the public interest, a Minister may, in respect of matters under his or her charge, demand that the said To, Do, Fu or Ken rectify the illegality or impropriety or take the necessary steps for improvement with regard to the handling of the said Self-government functions.
