4.

No person convicted of crimes related to election, voting or referendum held under law may be a member of reserve member of the commission.

 

5.

No two members or reserve members respectively may belong to the same political party or other organization simultaneously.

 

6.

Necessary adjustments to the result of election under paragraph 1 or 2 which conflicts with the above provisions or to the manner of filling a vacancy under paragraph 3 where by so doing the above provisions would be violated shall be provided by cabinet order.

 

7.

No member may be the president of the assembly or the chief executive simnultaneously.

 

8.

If a new election of members or reserve members is necessitated, the chairman of the commission shall immediately inform the assembly and the chief executive to that effect.

 

(Term of Office)

 

Article 183.

The term of office of members of the commission shall be four years, provided that they shall remain in office until their successors assume office.

 

2.

The term of office of members appointed to fill a vacancy shall remain in office during the unexpired portion of the term of his/her predecessor.

 

3.

The term of office of reserve members shall coincide with that of members.

 

4.

Any member or reserve member shall not forfeit his/her office until adjudication or judgment upon his/her election under paragraph 5 of Article 118 shall have become final.

 

(Forfeiture of Office)

 

Article 184.

A member of the commission shall forfeit his/her office when he/she becomes disfranchised or acquires a status coming under paragraph 6 of Article 180-5 or paragraph 4 of Article 182. The commission shall determine whether a member is disfranchised or has a status which comes under paragraph 6 of Article 180-5, unless he/she has already been disfranchised under Article 11 or Article 252 of the Public Election Law or Article 28 of the Law to Regulate Money Used for Political Activities.

 

2.

The provisions of paragraphs 2 to 4 of Article 143 shall apply mutatis mutandis.

 

(Dismissal)

 

Article 184-2.

In the event that the assembly of an ordinary local public body considers that any member of the commission is unable to perform his/her duties on account of mental or physical incompetence, has defaulted in the performance of any official duties, or has committed misconduct impairing the honor of said member of the commission, the assembly may, by resolution, dismiss any such member from its office. In this case, a public hearing concerning said dismissal shall be opened in a standing commission or special commission.
