(Subdivisions)

 

Article 158.

For the purpose of dividing the various affairs within the power of the governor of To, Do, Fu or Ken, there shall be created bureaus in To, nine divisions in Do, and Fu or Ken with a population of not less than 4 million, eight divisions in Fu or Ken with a population of not less than 2.5 million but less than 4 million, seven divisions in Fu or Ken with a population of not less than one million but less than 2.5 million, and six divisions in Fu or Ken with a population of less than one million.

 

2.

The governor of To, Do, Fu or Ken may, if necessary, by bylaw, increase or reduce the number of bureaus or divisions, notwithstanding the provisions of the preceding paragraph; provided that he/she shall comply with the spirit of the provisions of paragraphs 14 and 15 of Article 2, and maintain balance with the governmental organization of the State and the organization of subdivisions of other To, Do, Fu and Ken.

 

3.

The governor of To, Do, Fu or Ken shall report to the Minister of Home Affairs before he/she establishes bureaus of divisions (including hereinafter in this Article similar subdivisions by any other name) over and above the number prescribed in paragraph 1.

 

4.

The governor of To, Do, Fu or Ken shall report to the Minister of Home Affairs without delay upon establishment or change of names or assigned responsibilities of bureaus or divisions or increase or reduction of the number thereof (except when reported under the preceding paragraph).

 

5.

To, Do, Fu or Ken may, by bylaw, establish a necessary organization for management of a public enterprise.

 

6.

The governor of To, Do, Fu or Ken may create necessary sections under bureaus or divisions for the purpose of dividing the various affairs within his/her power.

 

7.

The mayor of a city, town or village may, by bylaw, create necessary divisions and sections for the purpose of dividing the various affairs within his/her power, provided that he/she shall comply with the spirit of the provisions of paragraph 14 and 15 of Article 2, and maintain balance with the organization of subdivisions of other cities, towns or villages.

 

(Transfer of Business)

 

Article 159.

Transfer of business from the outgoing to the income chief executive shall be provided for by cabinet order.

 

2.

The cabinet order referred to above may include provisions to impose an administrative fine not exceeding 100 thousand yen upon such outgoing chief executive as may have refused to transfer his/her business to his/her successor without due reasons.
