Such decision shall be given in writing to the chief executive together with the statement of the reasons therefor.

The governor of To, Do, Fu or Ken or the mayor of a city, town or village dissatisfied with such decision may appeal for review to the Minister of Home Affairs or to the governor of To, Do, Fu or Keri respectively.

 

4.

Notwithstanding the provisions of paragraph 1 pf Article 14 of the Administrative Complaint Review Law (Law No.160 of 1962), such appeal for review shall be made within twenty-one days from the day following such decision.

 

(Forfeiture of Office)

 

Article 144.

The chief executive shall not forfeit his/her office by reason of a complaint being filed in accordance with paragraph 1 of Article 206 of the Public Election Law, or an appeal being filed therefrom in accordance with paragraph 2 of Article 206 of the same law, or judicial proceedings being commenced under paragraph 1 of Article 203, paragraph 1 of Article 207, Article 210 or Article 211 of the same law, until the ruling, adjudication or judicial decision given thereon shall have become final. In case a judicial remedy is available to him/her under paragraph 1 of Article 210 of the same law, he/she shall retain his/her seat until the time limit fixed therein shall have expired without a plaint being filed by him/her, or his/her plaint or plaint note shall have been conclusively dismissed by the court, or his/her plaint shall have been withdrawn by himself/herself.

 

(Resignation)

 

Article 145.

The governor of To, Do, Fu or Ken or the mayor of a city, town or village, who wishes to resign from his/her office, shall tender his/her resignation to the president of the assembly at least thirty or twenty days respectively prior to the intended date of resignation. However, he/she may resign sooner, if approved by the assembly.
