INTRODUCTION:
This document is submitted in accordance
with the
provisions of paragraph 45.4
of the Guidelines on the
organization and method of work
of the MSC and MEPC
and their subsidiary bodies (MSC/Circ.8
16 and
MEPC/Circ . 331).
1 The paper submitted by Bulgaria
includes proposals to amend,
inter alia, adopted
Traffic Separation Schemes (TSS)
for the Strait of
Istanbul, the Strait of Canakkale
and the Marmara
Sea, hereinafter the Turkish
Straits.
2 The proposed amendments to TSS,
and
the paper as a whole, contravenes
SOLAS Chapter V
Regulation 8 as well as paragraph
3.4 of A.572(14) on
general provisions on ships'
routeing.
3 The proposal to stop the
implementation of TSSs in the
Strait of Istanbul and
the Strait of Canakkale, and
instead to apply Rule 9
of COLREGs in these waterways.
challenges the very
essence of the present ship routeing
system. It
disregards the fact that the
number of collisions in
the Straits have decreased considerably
over the last
four years since the TSSs were
established.
Furthermore, the paper by Bulgaria
ignores the
efficiency of Rule 10 of COLREGs
in the Turkish
Straits, which, in fact, represents
a refinement of
Rule 9 in maritime areas, with
particular
geographical and morphological
conditions combined
with dense maritime traffic,
such as the Turkish
Straits.
4 The rationale provided by Bulgaria
for the proposed amendment in
paragraph 1.1 is not
valid for the following reason:

The implementation of Rule 10 in the Turkish
Straits should be assessed
together with the
other regulations designed
to cover all aspects
of maritime traffic management
in the Straits. In
Rog 9000, para 3.1 of the
Navigation Guide to the
Straits and the Sea of Marmara,
it is stated that“local
vessels including ferries
and other shuttle boats
crossing between the two
sides of the Straits of
Istanbul and Canakkale shall
keep out of the way
of vessels proceeding from
north to south and
from south to north in the
traffic lanes as much
as possible by avoiding crossing
situations.
Nevertheless, If the,"e
is a risk of
collision they shall take
all necessary
precautions provided by Article
2 of COLREGs”.
5 Given the above, contrary to the
allegation in paragraph 1.1 of
MSC 70/11/13.
"large tankers or other
vessels sailing through
the Straits from north to south
shall not give way to
a small passenger" vessel
crossing the Straits”.
Experience shows that the ships'
routeing system
combined with national regulations
covering aspects
of traffic management and safety
have proved very
effective in reducing the dangers
of collisions.
