Preparation of a new report covering all aspects of safety and environmental protection including the review of the IMO Rules and Recommendations on Navigation through the Strait of Istanbul, Strait of Canakkale and the Marmara Sea

Note by the Russian Federation

SUMMARY

Executive Summary: With reference to paragraphs 5.49 to 5.52 of the Committee's report MSC 69/22, the Russian Federation submits its comments and proposals on the matter.

1    Following the Committee's decision at its sixty-ninth session, the NAV Sub-Committee at its forty-fourth session started preparation of a new report, covering all aspects of safety and environmental protection, including the review of the IMO Rules and Recommendations on Navigation through the Strait of Istanbul, Strait of Canakkale and the Marmara Sea. However, due to the heavy workload of the Sub-Committee it was unable to devote sufficient time to complete the task. Only a preliminary draft of a part for a new report was prepared by the Working Group and approved by the Sub-Committee.

2    Taking into account the urgency of the matter and the recommendation by the forty-fourth session of the Sub-Committee to convene a Working Group at the Committee's seventieth session, the Russian Federation submits the following comments and proposals.

3    In the opinion of the Russian Federation, the IMO efforts should be aimed at finding in the new report a meeting point of interests of those States whose ships navigate in the area and interests of Turkey as a coastal State, with the objective of improving safety of navigation, public and environment without jeopardizing the principle of freedom of navigation of merchant vessels through the Straits set forth by the Montreux Convention of 1936. The benefits of such an agreed solution to the problem are great particularly to the International Shipping Community as the traffic would be regulated by one set of internationally agreed rules.

4    On 1 May 1982, Turkey advised the IMO that it had introduced a "New Traffic Order conforming with the 1972 Collision Regulations" for the Bosphorus. Prior to that date traffic navigated to the left of the channel. After May 1982 vessels navigate to the right, starboard side of the channel, and endeavour not to cross the meridian line between the two lanes and to avoid overtaking unless forced to do so.
