4    NAV 43 then considered the proposal of Indonesia and was of the opinion that further work was necessary to develop the Indonesian proposal in an acceptable format for description of the proposed sea lanes and to address questions by some delegations as to the geographic delineation of the axis of sea lanes. Indonesia indicated it would proceed with this matter, and welcomed the offer of assistance by some delegations in preparing a revised proposal for MSC 69 in conformity with the draft General Provisions for Adoption, Designation and Substitution of Archipelagic Sea Lanes (NAV 43/1 5, paragraphs 3.25 and 3.26) to replace MSC 67/7/2.

5    In this regard, as stated at NAV 43 (NAV 43/15, paragraph 3.22), Indonesia confirms that its proposal is a partial archipelagic sea lanes proposal and that therefore:

.1    in particular, paragraphs 3.4. and 3.11 of the draft General Provisions for Adoption, Designation and Substitution of Archipelagic Sea Lanes will apply;

.2    the right of archipelagic sea lanes passage may be exercised, in accordance with paragraph 6.6 of the draft General Provisions for Adoption, Designation and Substitution of Archipelagic Sea Lanes, in all other normal passage routes used for international navigation or overflight and all normal navigational channels lying within such routes, including an east-west route and other associated spurs and connectors, through and over Indonesia's territorial sea and its archipelagic waters.

6    Indonesia further confirms that, as stated at NAV 43 (NAV 43/15, paragraph 3.23), except for internal waters, the right of innocent passage may be exercised, in accordance with paragraph 6.4 of the draft General Provisions for Adoption, Designation and Substitution of Archipelagic Sea Lanes, through Indonesia's territorial sea and its archipelagic waters.

7    The coordinates set out in the annex to this proposal replace the co-ordinates contained in MSC 67/7/2. Based on discussions at NAV 43, Indonesia has amended certain co-ordinates, as reflected in the annex to this paper. The amendment to certain co-ordinates are the results of consultation with some delegations and after more careful study of safety of navigation and overflight. In addition, certain co-ordinates and axis lines in the Natuna Sea presume enactment of new baseline legislation.

8    Regarding the view of the NAV Sub-Committee that further work was needed to develop an acceptable format for description of the proposed sea lanes, the annex to this paper has been prepared in consultation with various interested governments for the Committee's consideration and approval.

9    Appropriate scale charts depicting the axis lines of the proposed sea lanes will be made available for the Committee's consideration. The axis lines approximate the normal passage routes use for international navigation and pass over water which is suitable for navigation. The lines between points on the axis are measured along the geodetic datum as indicated in the relevant chart.

10    After the adoption of the Archipelagic Sea Lane by the MSC and within 6 months thereof Indonesia would, as far as practicable, indicate on the relevant nautical charts, the areas where the 10 per cent rule applies, as recommended by paragraph 3.1O of the amended GPSR.

Action requested of the Committee

11    The Committee is requested to consider and adopt the sea lanes identified in the annex to this paper.
