DRAFT REGULATIONS FOR THE CONTROL AND MANAGEMENT
OF SHIPS' BALLAST WATER TO MINIMIZE THE TRANSFER OF
HARMFUL AQUATIC ORGANISMS AND PATHOGENS
Regulation 1; General Obligations
The Government of each Party to the Convention shall promote measures to minimize the transfer of harmful aquatic organisms and pathogens through ships' ballast water and associated sediments.
Regulation 2: Definitions
For the purpose of this Annex:
"Guidelines" - means Guidelines for the Implementation of Regulations for the Control and Management of Ships' Ballast Water to Minimize the Transfer of Harmful Aquatic Organisms and Pathogens
"Harmful Aquatic Organisms
and Pathogens" - means aquatic organisms and pathogens which, if introduced into the sea, estuaries or fresh water courses, may create hazards to human health, harm living resources and aquatic life, damage amenities or interfere with other legitimate uses of the sea
"Ballast Water Management" - means the procedures for of handling ballast water with a view to minimizing the transfer of harmful aquatic organisms and pathogens
"Ballast Water" - means water and entrained solids used as ballast;
"Sediments" - means solid matter settled out of ballast water within a
ship.
Regulation 3: Applications
The provisions of this Annex shall apply to all ships that carry ballast water [which may be harmful], except where expressly provided otherwise in regulation 4 of this Annex.
