GUIDELINES FOR THE DEVELOPMENT OF GARBAGE MANAGEMENT PLANS
THE MARINE ENVIRONMENT PROTECTION COMMITTEE,
RECALLING Article 38(a) of the Convention on the International Maritime Organization concerning the functions of the Committee,
NOTING resolution MEPC.65(37) by which the Committee, in accordance with article 16(2) of MARPOL 73178, adopted regulation 9 of Annex V of MARPOL 73/78, malting it mandatory for every ship of 400 tons gross tonnage and above, and every ship certified to carry 15 persons or more, to carry a garbage management plan,
NOTING ALSO that there is an obligation to provide guidelines for the development of garbage management plans to assist shipowners and/or operators in the implementation of regulation 9(2) of Annex V of MARPOL 73/78,
HAVING CONSIDERED, at its thirty-eighth session, the draft guidelines for the development of a garbage management plan,
1. ADOPTS the Guidelines for the Development of Garbage Management Plans, the text of which is set out at Annex to this resolution; and
2. URGES Governments to take the necessary steps to ensure that the ships' garbage management plans are developed in accordance with these guidelines in order to be in a position to comply with the requirements of regulation 9 of Annex V of MARPOL 73/78 upon their entry into force.
