Chapter 4 Request for Revocation of Judgment

 

Section 1 Request procedures

Should a judgment delivered by the High Marine Accidents Inquiry Agency be found dissatisfactory, a request for revocation of judgment may be filed with the Tokyo High Court within 30 days of pronouncement.

In the event of dissatisfaction with a judgment pronounced by the Tokyo High Court, a further appeal may be filed with the Supreme Court.

When the judgment of the High Marine Accidents Inquiry Agency is revoked as a result of a judiciary court trial, the High Marine Accident Inquiry Agency is required to reopen the case.

 

Section 2 Number of requests filed

 

In 1998, five requests for revocation of judgment were handled, including two filed with the Tokyo High Court, one with the Supreme Court and two carried over from 1997. Judgments were passed on four of these cases, while one remains before the court.
