Chapter V. Handling of Inquiry Affairs

Section 1. General Provisions

(Place to Conduct Inquiry)

Article 22. An inquiry court shall be opened at each Marine Accidents Inquiry Agency (including the Branch; hereinafter the same in this Chapter). However, the Single Judge may open an inquiry court at any place.

2. Notwithstanding the provisions of the principal clause of paragraph 1, the Director General of the High Marine Accidents Inquiry Agency may, in case of necessity, order to open inquiry court at any other place of the Marine Accidents Inquiry Agency.

(Language)

Article 23. In the Marine Accidents Inquiry Agency, the Japanese language shall be used. However, this shall not be applied to marine technical terms.

2. The Marine Accidents Inquiry Agency may use an interpreter if there is any person concerned in the inquiry who is unable to understand the Japanese language.

(Protocol of Inquiry)

Article 24. With regard to an inquiry, the protocol of inquiry shall be drawn up, and all the inquiry proceedings shall be recorded.

2. The protocol of inquiry shall be put in order within five (5) from the date when the process of inquiry was completed with.

3. The protocol of inquiry shall be signed and sealed by the Presiding Judge or the Single Judge and Clerk.

Section 2. Deliberation

(Method of Judgement)

Article 25. Judgement shall be deliberated by the Judges in full number, or the Judges and Commissioned Judges.
