(3) A person who has once held the position of a professor as prescribed in Article 3, item 2 d), of the Cabinet Order for Enforcement of Marine Accidents Inquiry Law (Cabinet Order No. 54, 1948) or who has held the position of an assistant professor as prescribed in the same provision not less than three (3) years, or who has held the position of a high school teacher among teachers as prescribed in Article 4, item 2 b), of the said Cabinet Order not less than ten (10) years;

(4) A person qualified as a lawyer.

(Reasons for Unqualification for Marine Counsellor)

Article 13. A person who comes under one of the following items shall not be a Marine Counsellor:

(1) A person who was punished with imprisonment or a graver punishment;

(2) A person who was adjudged incompetent or quasi-incompetent;

(3) A person who was dismissed, removed or expelled from official post by disciplinary decision within the last two (2) years.

(Denial and Revocation of Registry for Marine Counsellor)

Article 14. The Director General of the High Marine Accidents Inquiry Agency may deny or revoke the registry of a Marine Counsellor with the consent upon a ruling made by the High Marine Accidents Inquiry Agency.

2. In regard to the ruling mentioned in paragraph 1, the provisions concerned with the proceedings of inquiry shall apply mutatis mutandis thereto.

(Regulations for Registry of Marine Counsellor)

Article 15. The registry of a Marine Counsellor shall be provided for in the Regulations for Registry of Marine Counsellor in addition to these regulations.

(Time to Select Counsellor and Right of Examinee's Relative to Select Counsellor)

Article 16. An Examinee or a Designated Person Concerned in a Marine Accident may select a Counsellor at any time before the end of the pleadings at a court.
