Chapter V. Inquiry by a Local Marine Accidents Inquiry Agency

(Commencement of Inquiry)

Article 35. A Local Marine Accidents Inquiry Agency shall commence inquiry upon receipt of the offer therefor from the Commissioner.

(Inquiry and Judgement Open to Public)

Article 36. Inquiry and Judgement shall be conducted in the declared court publicly.

(Authority of Presiding Judge)

Article 37. The presiding Judge shall preside the inquiry and maintain the order in the court.

2. The Presiding Judge may order any person who interferes with inquiry to leave the court, or may take other necessary measures for the maintenance of order in the court.

(Summon and Examination of Examinee)

Article 38. The Local Marine Accidents Inquiry Agency may summon the Examinees at the dates for inquiry, and may examine them.

(Oral Proceedings)

Article 39. In case that an Examinee is designated, the judgement shall be rendered on the basis of oral proceedings. However, if he fails to present himself at the date for inquiry with no justifiable reasons, the judgement may be made without hearing his statement.

(Examination of Evidence)

Article 40. The Local Marine Accidents Inquiry Agency may examine the necessary evidences either on request or ex officio.

2. Prior to the date for the first inquiry, the Local Marine Accidents Inquiry Agency may not examine the evidence without taking the measures as follows:

(1) Investigating vessels or other places;

(2) Causing persons to make reports or to submit books, documents or other articles;
