Further discussion on the definitions on "Designated Authority" and "Recognized Security Organization" was needed at the forthcoming ISWG meeting.

On reviewing the text of the draft amendments to SOLAS chapter XI and Part A of the draft ISPS Code, as prepared by the Drafting Group, the MSWG agreed to put the text in dispute in square brackets for further consideration at the forthcoming ISWG meeting.

Having completed its work on the draft amendments to SOLAS regulation V/19.2.4 and SOLAS chapter XI and mandatory Part A of the new draft ISPS Code, as set out in annexes 1 and 2, the MSWG, in recommending their approval by the Committee for circulation to the MS Conference for consideration and formal adoption, invited Member Governments to consider them at the national level with a view to reviewing them at a further session of the ISWG, subject to the Committee's approval thereof (see paragraph 92 below).

Due to time constraints the MSWG was not able to consider and prepare texts for recommendatory Part B of the draft ISPS Code and kept it as set out in MSC 75/WP.7, annex 3.

The MSWG, in considering the work done and progress made at this session, was content that it had reached a basis for a successful MS Conference in December 2002, however it agreed that it would need another one week intersessional meeting of the ISWG before the MS Conference to:
 
.1 review and finalize the draft amendments to SOLAS chapter XI and Part A of the draft ISPS Code;
 
.2 review the proposed texts which have been removed from Part A of the draft ISPS Code and kept in abeyance; and
 
.3 prepare and finalize the recommendatory Part B on guidance of the draft ISPS Code,
 
and requested the Committee to authorize another ISWG meeting from 9 to 13 September 2002 for the above purpose with a view to submit finalized texts of draft amendments to SOLAS chapter XI and the draft ISPS Code to the MS Conference.

The MSWG agreed to the revised conference resolutions, as set out in annex 5, and invited the Committee to approve them for circulation to the MS Conference for consideration and formal adoption.

The MSWG agreed to consider the work plan for future work at the forthcoming ISWG session, subject to the Committee's approval thereof.

The Committee is invited to approve the report of the MSWG in general and, in particular to:
 
.1 note and approve for circulation to the MS Conference the four alternatives for draft amendments to SOLAS regulation V/19.2.4 with a view to consideration, decision and formal adoption (annex 1);
 
.2 note and approve for circulation to the MS Conference the draft amendments to SOLAS chapter XI, with a view to consideration and formal adoption (annex 1);
 
.3 note and approve for circulation to the MS Conference the text of mandatory Part A of the new draft International Ship and Port Facility Security (ISPS) Code with a view to consideration and formal adoption (annex 2);
 
.4 note the proposed texts of Part A of the ISPS Code, which have been kept in abeyance for review by the ISWG at the forthcoming meeting in September 2002 (annex 3);
 
.5 note the proposed recommendatory Part B on guidance of the draft ISPS Code for review by the ISWG at the forthcoming meeting in September 2002 (annex 4);
 
.6 note and approve the draft conference resolution for circulation to the MS Conference with a view to consideration and formal adoption, (paragraph 66 and annex 5);
 
.7 approve the draft performance standards for a ship security alarm installation for submission to COMSAR 7 and to instruct the Sub-Committee to finalize it with top priority for availability before the corresponding requirement enters into force (paragraph 46 and annex 6);
 
.8 request the Secretary-General to communicate with Secretary-General of the WCO as set out in paragraph 64 and annex 7;
 
.9 approve the draft functional requirements for a long-range identification system for submission to NAV 48 and to instruct the Sub-Committee to advise the MS Conference thereon accordingly (paragraph 69, annex 8);
 
.10 take action on work to be undertaken by other bodies as requested in paragraph 67;
 
.11 agree on another one week session of the ISWG from 9 to 13 September 2002 with the terms of reference as given in paragraph 92 and to allow for adequate arrangements to be made for appropriate consideration of the ISWG outcome by SC 76 before the MS Conference.
