REPORT OF THE WORKING GROUP ON IMO MSC/CIRC.622

RECOMMENDATIONS TO GOVERNMENTS FOR COMBATING PILACY AND ARMED ROBBERY AGAINST SHIPS

 

The Working Group recommended that chapter 3 of the Guidelines in MSC/Circ.622 be revised and suggested the following amendments in addition to those suggested by the Brasilia seminar and workshop, as amended in order to make it more global.

Paragraph 2: replace "neutralize" in line 2 by: "deal with",

Paragraph 3: replace "merchant ships" in line 1 by: "ships", after "MSC/Circ.623" in line 3 add paragraphs 10 to 23 and 30 of this document, replace "ensure that" in line 7 by: "encourage", and insert "to" in line 7 after "masters".

(see the suggestion in the last paragraph of this annex)

Paragraph 4: after "attack" in line 2 add "and flag States to develop Action Plans detailing the actions to be taken on the receipt of a report of an attack"

Add a new paragraph 5 bis:

"5 bis In some regions, where acts of piracy often take place outside the jurisdiction of the coastal States or on the high seas, the coastal States concerned are recommended to adjust their legislation, if necessary, to enable those States to apprehend and prosecute the pirates."

Add a new paragraph 6 bis 2:

"6 bis 2 immediately upon receipt of an alert or a post attack report, as appropriate, the RCC concerned should alert other ships in the area to the incident utilizing any appropriate communication means available to it, in order to create or increase their awareness;"

In the new paragraph 6 bis 1 suggested by the Brasilia seminar and workshop, replace "required" by "encouraged"

Add a new paragraph 7:

"7 On communication and co-operation between various agencies, and the response time after an incident has been reported to the coastal State:

.1 an incident command system for tactical as well as operational response should be adopted in each country concerned to provide a common terminology; integrated communications; a unified command structure; consolidated action plans; a manageable span of control; designated incident facilities; and comprehensive resource management;
