(2) With respect to the public notice according to paragraph 1 of Article 79 and paragraph 1 of Article 81 of the Civil Code which is applied mutatis mutandis under paragraph 15, if failing to give said public notice, or giving said public notice in an unjust way.
(Special Law)
Article 261.
When a special law, applicable only to one ordinary local public body, has been passed by the Diet or by the House of Councillors in emergency session, the president of a House which has passed it later than the other (or, if the decision of the House of Representatives has become the decision of the Diet, the Speaker of the House of Representatives, or if it has been passed by the House of Councillors in emergency session, the President of the House of Councillors) shall notify the Prime Minister to that effect together with the law.

When notified under the preceding paragraph, the Prime Minister shall immediately notify the Minister of Home Affairs together with the law, who shall within five days from the day of such notification, notify the chief executive of the ordinary local public body to be affected thereby and transit to him/her the law and other related documents.

When notified under the preceding paragraph, the chief executive of such ordinary local public body shall cause the election administration commission to put such law to a popular vote within sixty days but not earlier than thirty-one days from such date.

When such vote is opened, the chief executive shall within five days from such date, report its result to the Minister of Home Affairs together with the related documents, who shall immediately report thereon to the Prime Minister. This shall apply also when the chief executive has confirmed that the result of such vote has become final.
5.
When the Prime Minister receives a report under the preceding paragraph that the result of such vote has become final, he/she shall immediately take steps to promulgate the law and notify the Speaker of the House of Representatives and the President of the House of Councillors to that effect.
(Applicable Provisions)
Article 262.
Except as otherwise provided by cabinet order, the provisions of the Public Election Law relating to elections in ordinary local public bodies shall apply mutatis mutandis to a popular vote under paragraph 3 of the preceding article.
