The assembly shall have the right to demand the audit commissioners to audit the affairs of said ordinary local public body (with the exception of those self-governing functions stipulated by cabinet order as coming under the powers of the local labor commission and the expropriation commission; also with the exception of those statutory entrusted functions stipulated by cabinet order to be inappropriate for inspection by the assembly because of possible jeopardy to national safety, etc.), and to submit a report on the result of the audit. The provision of the latter part of paragraph 2 of Article 199 shall apply mutatis mutandis to the audit mentioned above.

 

(Submission of Opinion)

 

Article 99.

The assembly may present a letter of opinion to the government agency concerned upon any subject which is of public interest to the ordinary local public body.

 

(Investigation)

 

Article 100.

The assembly may conduct investigations in relation to the affairs of the ordinary local public body (with the exception of those self-governing functions stipulated by cabinet order as coming under the powers of the local labor commission and the expropriation commission; also with the exception of those statutory entrusted functions stipulated by cabinet order to be inappropriate for inspection by the assembly because of possible jeopardy to national safety, etc: the same also being applicable in the following paragraph), and may demand the presence and testimony of witnesses, and the production of records for such purpose.

The provisions of law of civil procedure relative to the testimony of witnesses, except as otherwise herein provided, apply mutatis mutandis, where the assembly demands the testimony under the preceding paragraph. However, the provisions relative to administrative or penal fine, detention or arrest shall not be applicable.

 

3.

Anyone who without due reasons has failed to appear in, or produce records to, the assembly or refused to testify upon its demand, shall be imprisoned without hard labor not to exceed six months or fined not to exceed 100 thousand yen.
