Chapter VI The Assembly
Section I. Organization
(Establishment)
Article 89.
There shall be established an assembly in each ordinary local public body.

Article 90.
The number of the members of the assembly of To, Do, Fu or Ken shall be stipulated by law.

The number of the members of the assembly of To, Do, Fu or Ken, depending on To, Do, Fu or Ken under following each section, shall be stipulated as less than the number in said following each section. In case of To, the number obtained by dividing the population of the area covered by special wards by 1 million shall be added to the number in said following each section (in case the number exceeds 130, 130 shall be the ceiling).
1. To, Do, Fu or Ken with a population of less than 750 thousand 40
2. To, Do, Fu or Ken with a population of 750 thousand up to 1 million
The number obtained by adding one for each additional population of 50 thousand over 700 thousand to 40
3. To, Do, Fu or Ken with a population of more than 1 million
The number obtained by adding one for each additional population of 70 thousand over 930 thousand to 45 (in case the number exceeds 120, 120 shall be the ceiling.)

In To, Do, Fu or Ken whose number of the members of the assembly stipulated by bylaw under paragraph 1 exceeds the number in the preceding paragraph due to the decrease of population, the number stipulated by bylaw shall be considered as legal, as long as the incumbents who were elected by ordinary election whose date was noticed before the excess remains in office.

The alteration of the number under paragraph 1 may not take place except at the time when a general election is held.

Article 91.
The number of the members of the assembly of a city, town or village shall be stipulated by bylaw.

The number of the members of the assembly of a city, town or village, depending on a city, town or village under following each section, shall be stipulated as less than the number in said following each section.
