Any person contesting the validity of a signature in the signature book may file an objection with the commission during the inspection period as provided for in paragraph 2.

The commission shall give its finding upon such objection within fourteen days from the day of its receipt. If it is sustained, the commission shall forthwith re-certify accordingly, inform the objector and other persons concerned, and give public notice to that effect; and if rejected, the applicant shall be immediately so informed.

The commission shall, when the inspection period under paragraph 2 has expired without any objection filed, or when findings have been given on all the objections filed, give public notice of the fact as well as the total number of valid signatures, and return the signature book to the representative of petitioners.

Where the petition concerns a bylaw of To, Do, Fu or Ken, appeal may be made for the review of the finding given under paragraph 5 within ten days to the election administration commission of To, Do, Fu or Ken.

Where the petition concerns a bylaw of a city, town or village, a suit may be filed against the finding given under paragraph 5 within fourteen days with the District Court, which decision shall be unappealable except to the Supreme Court.

A suit may be filed with the High Court against the adjudication given on appeal or review under paragraph 7, within fourteen days from the day of its receipt.

As soon as the adjudication of the election administration commission of To, Do, Fu or Ken or the decision of the court has become final, such commission or court shall send a copy of such adjudication or decision to the election administration commission of the city, town or village, which shall forthwith notify the representative of petitioners to that effect.

In the foregoing cases, adjudication shall be given within twenty days from the day of the receipt of appeal for review, and for the decision of the court, every effort shall be made that such decision be reached within one hundred days from the day when the case is accepted.

 

12.

The suit under paragraphs 8 and 9 shall fall under the exclusive jurisdiction of the District Court or the High Court, which exercises jurisdiction over the seat of the election administration commission which has given such finding or adjudication.

 

13.

Article 13 of the Administrative Litigation Procedure Law (Law No.139 of 1962) shall not apply to the suit under paragraphs 8 and 9, notwithstanding the provisions of Article 43 of the said law, and Articles 16 to 19 of the said law shall not apply, except to two or more suits contesting the validity of signatures in the signature book.
