1 Pursuant to the Committee's instructions, reports on piracy or armed robbery are forwarded by the Secretariat to the coastal States concerned for comments and advice on any relevant action they have taken in accordance with national and international law.
2 The Committee, at its fifty-ninth session (MSC 59/33, paragraph 19.22), agreed that, as coastal States can only be expected to maintain surveillance over waters under their jurisdiction, only those reports which clearly show that incidents have occurred within the territorial waters of the coastal States identified in the reports or involve nationals of a State as an offender, should be referred by the Secretariat to the Governments concerned for action as indicated above.
3 Pursuant to the above decision, comments and advice sought by, and received from, coastal States concerned by the time of writing are attached hereto for information and action as appropriate.
