TERMS OF REFERENCE FOR THE NAV SUB-COMMITTEE ON
ADOPTION OF SEA LANES IN ARCHIPELAGIC WATERS

Taking into account documents MSC 67/7/2 (Indonesia) and MSC 67/7/3 (Australia) and discussions in plenary on sea lanes in archipelagic waters (paragraphs 7.30 to 7.41 of document MSC 67/22), the NAV Sub-Committee is instructed to:

.1  review the General Provisions on Ships' Routeing (resolution A.572(14), as amended), and determine whether they provide adequate guidance and criteria for the submission of proposals and the adoption of archipelagic sea lanes as "routeing measures" and recommend any appropriate amendments that may be necessary;

.2  on the basis of the outcome of its review of the General Provisions, consider document MSC 67/7/2 and make appropriate recommendations:

- regarding the adoption of the archipelagic sea lanes proposed therein; and

- on the navigation of foreign vessels and aircraft outside the currently proposed sea lanes in accordance with article 53(12) of UNCLOS (as referred to in paragraphs 11 and 12 of MSC 67/7/2) and article 52(1) of UNCLOS (as referred to in paragraph 10 of MSC 67/7/2);

.3  advise the Committee on any associated rules and regulations applicable to archipelagic sea lanes as may be submitted by the archipelagic State for the Committee's consideration; and

.4  advise directly the twentieth session of the Assembly of progress made in its consideration of document MSC 67/7/2 so that the Assembly as appropriate, could authorize MSC 69 to adopt the proposed archipelagic sea lanes if the Assembly has not done so.
