KOREA: SUBSIDISATION OF SHIPBUILDING INDUSTRY
Measures complained of:
 
Subsidies granted to, or otherwise benefiting, Korean shipbuilding companies by the Republic of Korea.

Steps in the TBR procedure:
 
The complaint was lodged on 24 October 2000 and the notice of initiation of the examination procedure was published on 2 December 2000 (OJ C 345/5). Visits to Korean and EC shipyards were concluded on 20 March 2000 and the report transmitted to Member States on 8 May 2001. A supplementary report on export subsidies was transmitted to Member States on 4 July 2001. The supplementary report has confirmed the findings in the original report.
Findings:
 
The Korean Government appears to have granted both export and actionable subsidies within the meaning of Article 1 of the ASCM to Korean shipbuilders.
Action taken:
 
The Commission has pursued the matter with the Korean authorities in order to obtain amicably the immediate withdrawal of the subsidies or the removal of the adverse effects. It was not, however, possible during discussions so far to reach agreement. Unless such an amicable solution is achieved, the Commission has stated it will proceed with the initiation of a WTO dispute settlement procedure at the same time as the introduction of a temporary defense mechanism, that requires the approval of the Council.
Outcome:
 
No decision on the temporary defense mechanism was taken during the Industry Council of 5 December 2001. In the meantime, the Commission has accepted the complainant's request to update the findings of the investigation on the adverse trade effects and injury aspects. The updating investigation is currently running its course.
