(1) Revocation of license (including the certificate of approval on Article 23-2, paragraph 1, of Law for Ship's Officers; hereinafter the same);
(2) Suspension of duty;
(3) Reprimand.
2. The period of suspension of duty shall be not less than one (1) month but not more than three (3) years.
(Exemption from Punishment)
Article 6. In case that a matter falls under Article 4, paragraph 2, when the necessity of the disciplinary punishment is not deemed, the Marine Accidents Inquiry Agency may exempt the punishment from which the nature or condition of the marine accident, or the career and other circumstance of the person concerned.
(Not twice for the same)
Article 7. The Marine Accidents Inquiry Agency shall not inquire a case into which the final judgement has already been rendered as to the merits.
Chapter II. Organization and Jurisdiction of Marine Accidents Inquiry Agency
(Jurisdiction)
Article 8. The Marine Accidents Inquiry Agency shall be under the jurisdiction of Minister for Transport.
(Classification)
Article 9. The Marine Accidents Inquiry Agency shall be classified into Local Marine Accidents Inquiry Agency and High Marine Accidents Inquiry Agency.
2. The name, location and jurisdiction of Local Marine Accidents Inquiry Agency and the location of High Marine Accidents Inquiry Agency shall be prescribed by a Cabinet Order.
3. The Local Marine Accidents Inquiry Agency within the area where is under the jurisdiction of Okinawa prefecture may establish a branch of the Local Marine Accidents Inquiry Agency within the area of Okinawa prefecture, and cause the branch to deal with a part of functions for the time being.
