The assembly may not demand testimony or production of records, without the authorization from an appropriate government agency, upon the fact declared by the witness to be an official secret, which has come into his/her knowledge because of his/her official position. The appropriate government agency must state its reasons when it refuses such authorization.

The assembly may, if it is not satisfied with the stated reasons, demand a public declaration from the agency that such testimony or production of records will compromise the public interest.

If the agency fails to make such public declaration within twenty days from its receipt of the demand under the preceding paragraph, the witness may not longer refuse to testify or produce records.

Any witness who has made a false statement under an oath administered in accordance with the applicable provisions of law of civil procedure as referred to in paragraph 2 of this Article, shall be imprisoned without hard labor for three months up to five years.

The punishment prescribed above may be mitigated or exempted, if such offender confessed his/her guilt prior to the resolution of the assembly concluding the investigation.

 

9.

The assembly shall request the prosecution of any person suspected of the offense prescribed in paragraph 3 or 7: provided that any person suspected of false statement may be excused, if he/she confessed his/her guilt prior to the resolution of the assembly concluding the investigation.

 

10.

Any organization within the area of an ordinary local public body shall comply with such requests as may be made by the assembly for the purpose of investigations under paragraph 1.

 

11.

The assembly shall, prior to the investigation under paragraph 1, set a limitation upon the expenses for such investigation within the fixed amount of the budget. A new resolution of the assembly shall be required to expend beyond such limitation.

 

12.

The national government shall send the Official Gazette and other government publications to the assemblies of To, Do, Fu or Ken, and send the Official Gazette and such government publications as are deemed specially relevant to cities, towns or villages to the assemblies of cities, towns or villages.

 

13.

To, Do, Fu or Ken shall send the Public Gazette and other appropriate publications to the assemblies of cities, towns or villages within its area as well as of other To, Do, Fu or Ken.
