4-3. AIRPORT DEVELOPMENT SPECIAL ACCOUNT LAW

 

(Establishment)
Article 1. This law provides for the establishment and administration of a Special Account, separate from the General Account, for the purpose of clarifying government expenditures related to:
- Airport projects administered and managed by the Minister of Transport, including work involving establishment, reform, disaster restoration, maintenance, or any other work related to the administration of airports as prescribed by paragraph 1 of Article 2 (Definition and Classification of Airports) of the Airport Development Law (Law No. 0, 1956), or any other airport serving the public (including facilities to be attached to the said airports as prescribed by Cabinet Order, hereinafter referred to as “airport”);
- Projects involving procedures for prevention of aircraft noise nuisance in areas surrounding such airports;
- The State Investment Fund, prorated sharing of costs, and any other expenses or loans of finds;
- The Aeronautical Safety College and affiliated organizations prescribed by Article 29 of the Transport Ministry Establishment Law (1949, Law No. 157);
- Inspection of air navigation facilities as prescribed by Article 2, paragraph 4 (Definition of air navigation facilities) of the Civil Aeronautics Law (1952, Law No. 231) and other inspections and investigations related to the assurance of air traffic safety (hereinafter referred to as “flight inspection projects”).

 

2. The following items, in addition to those prescribed under the preceding paragraph, shall be managed in the Special Account:
(1)Any construction heavily related to construction which comes under the airport development service performed by the Minister of Transport (hereinafter referred to as “derivative work”);
(2)Any construction heavily related to construction which comes under the airport development project work entrusted to and performed by the Minister of transport (hereinafter referred to as “consigned work”) and flight inspection projects, etc. with which the Minister of Transport is entrusted (hereinafter referred to as “consigned projects”);
(3)Any clerical work at the airport offices, etc. (any airport office or any other local agency located at the airport as prescribed by Article 52 (airport offices, etc.) of the Ministry of Transport Establishment Law performing the airport development project other than those prescribed under the preceding two subparagraphs (hereinafter referred to as “airport office's clerical work, etc.”).

 

(Administration)
Article 2. The Minister of Transport shall have jurisdiction over the Special Account as prescribed by the Law and Ordinance.
