when offering a comment in accordance with the provisions of the latter half of the preceding paragraph obtain a resolution from the assembly.

 

4. The regional administrative organization which manages a second class airport under the provision of paragraph 2 shall be regarded as the aerodrome provider with regard to the application of the provisions of the Civil Aeronautics Law (1952, Law No. 231).

 

(Establishment and Administration of Third Class Airports)
Article 5. Any regional administrative organization, which is designated by conferring with other regional administrative organizations specified by Cabinet Order, shall establish and manage/operate third class airports.

 

2. Mutual conferment under the provision of the preceding paragraph shall require a resolution from the assembly of the respective regional administrative organization concerned.

 

3. The Minister of Transport may, when deemed necessary in reference to the conferment prescribed under paragraph 1, mediate said conferment upon request from the regional administrative organizations concerned.

 

(Sharing Development Costs for Second Class Airports and Others)
Article 6. When the Minister of Transport establishes or modifies a runway, landing area, taxiway, or apron for public use in a second class airport established and managed/operated by the Minister of Transport, seventy-five percent (75%) of the required development cost shall be borne by the State and twenty-five percent (25%) by the prefectural government of the prefecture in which the airport concerned is located.

 

2. With regard to the preceding paragraph, when the establishment of the airport concerned significantly benefits a prefectural government other than that in which the airport is located, the Minister of Transport may allocate a portion of the prorated cost for the prefectural government in which the airport is located to the other prefectural government which is benefiting indirectly, to an extent which is weighted against such benefit.

 

3. The Minister of Transport shall, when intending to perform the tasks specified in paragraph 1, negotiate with the prefectural government which is to share the prorata cost prescribed under the provisions of the previous two paragraphs.

 

Article 7. A prefectural government may cause such cities, towns, and villages in the prefecture, which share the benefit of the establishment of the airport
