CABINET ORDER RELATING TO THE ENFORCEMENT OF CIVIL AERONAUTICS LAW

 

Article 1. Any aircraft specified in a Cabinet Order under the proviso of Article 10 paragraph 2 of Civil Aeronautics Law is an aircraft as listed below:
(1)Any aircraft which has obtained permission under the proviso of Article 127 of Civil Aeronautics Law (except any aircraft which operates between points in Japan in connection with the operation as listed in item (1) of Article 126 paragraph 1 of the same Law);
(2)Any aircraft which does not have Japanese nationality, and has been repaired, altered, or produced in Japan.

 

Article 2. Any aircraft specified in a Cabinet Order under the proviso of Article 10 paragraph 4 of Civil Aeronautics Law (including the case as applied accordingly under Article 10-(2) paragraph 2) shall be an aircraft as listed below:
(1)Any imported aircraft for which any foreign state which is a contracting state of the Convention on International Civil Aviation has furnished certification or has taken other action with regard to its airworthiness;
(2)Any aircraft which has obtained airworthiness certification under Article 10 paragraph 1 or Article 10-(2) paragraph 1 of Civil Aeronautics Law.

 

Article 3. Any air navigation facility under Article 38 paragraph 1 of Civil Aeronautics Law is an air navigation facility as listed below:
(1)Aeronautical light (except aeronautical obstruction light);
(2)NDB (non-directional radio beacon facility; hereinafter the same shall apply.);
(3)Range;
(4)Z marker
(5)VOR (very high frequency omnirange facility; hereinafter the same shall apply.);
(6)TACAN
(7)Instrument landing system
(8)DME (distance measuring equipment; hereinafter the same shall apply);

 

Article 4. Inspection under the provision of Article 47 paragraph 2 of Civil Aeronautics Law is to be conducted two times or more each year.

 

Article 4-(2). Compenzation under the provision of Article 49 paragraph 3 of Civil Aeronautics Law (including when applied accordingly under Article 55-(2) paragraph 2, Article 56, and Article 56-(4) paragraph 3 of the same Law) is to be made by paying money. However, the same shall not apply when another way of compenzation has been determined after consultation between parties concerned.
