CHAPTER ?. - FOREIGN AIRCRAFT

 

(Flights of Foreign Aircraft)
Article 126. Any aircraft having the nationality of any foreign state which is a Contracting State to the Convention on International Civil Aviation (hereinafter referred to as “Contracting State”)(except any aircraft which is used for an air transport service by any person who has obtained permission under Article 129 paragraph 1 (hereinafter referred to as “foreign international air carrier”), any aircraft which is used for the transportation by any person who has obtained permission under article 130-(2) or any aircraft which is used by any foreign state, any public entity or its equivalent of any foreign state) shall obtain permission from the Minister of Transport when it engages in a flight as mentioned below.
However, the same shall not apply to any flight operated along designated airways.
(1)A flight originating outside of Japan with a final destination within Japan.
(2)A flight originating within Japan and with a final destination outside of Japan.
(3)A flight through Japanese airspace without landing within Japan.

 

2. Any aircraft, having the nationality of a Contracting State, which is used by any foreign state, any public entity or the equivalent of any foreign state and any aircraft having the nationality of any foreign state other than a Contracting State (except any aircraft which is used for the air transport service by any foreign international carrier or any aircraft which his used for the transportation by any person who has obtained permission under Article 130-(2)), shall obtain permission from the Minister of Transport when it engages in a flight referred to in any item of the preceding paragraph.

 

3. Any aircraft used in military, customs or police service is to be regarded as “aircraft used by a state” in application of the provisions of the preceding two paragraphs.

 

4. Any aircraft having the nationality of any foreign state shall, when engaged in a flight referred to in each subparagraph of paragraph 2, land at the designated aerodrome without delay, when requested to do so by the Minister of Transport.

 

5. Any aircraft having the nationality of any foreign state shall, when engaged in a flight referred to in paragraph 1, subparagraph (1) or (2), land or take-off from an aerodrome designated by the Minister of Transport except in very unfavorable weather conditions or other mitigating circumstances. However, the same shall not apply to cases approved by the Minister of Transport.
