CHAPTER ?. - AIR TRANSPORT SERVICE, ETC.

 

(License)
Article 100. Any person who manages a scheduled air transport service shall have a license for each service route from the Minister of Transport.

 

2. Any person who will obtain a license under the preceding paragraph shall submit an application to the Minister of Transport, describing a business program (a program for the operation of aircraft and the maintenance necessary thereof), an estimate of the income and expenses of the business and other matters as may be specified in Ordinances of the Ministry of Transport.

 

3. The Minister of Transport may request the applicant to submit a copy of the commercial register and other pertinent documents in addition to those specified in the preceding paragraph.

 

(Licensing Standards)
Article 101. Where there has been an application under the preceding Article, the Minister of Transport shall examine whether it conforms to each of the following:
(1)The operation of the business meets the needs of the public;
(2)The opening of the business shall not lead to an excessive supply over the demand of air services on the route;
(3)The business program shall be suitable from the viewpoint of business and air safety;
(4)The applicant shall be able to conduct the business properly;
(5)The applicant does not come under any of the following:
a)Any person who comes in any subparagraph of Article 4, paragraph 1.
b)Any person whose license for scheduled air transport service, nonscheduled air transport service, air freight forwarding service, or aerial work was cancelled, and less than two years have passed since the date of such cancellation;
c)Any person who has been sentenced to a penalty more severe than imprisonment for violation of any provision of this Law, and less than two years have passed since completion of the sentence or since it was suspended;
d)Any juridical person whose officer or officers come under any of the provisions of b) or c).

 

2. When he deems that the application conforms to the standards mentioned in the preceding paragraph of the same paragraph, the Minister of Transport shall issue a license for a scheduled air service.
