Article 42. The aerodrome provider or any person who has been granted permission to install an air navigation facility (hereinafter referred to as “air navigation facility provider”) shall, when the works of the facility under the said permission have been completed, avail the said construction to an immediate inspection by the Minister of Transport.
2. The Minister of Transport shall approve the facility, upon confirming the facility mentioned in the application conforms to the establishment plan, as the result of the inspection under the preceding paragraph.
3. The aerodrome provider or the air navigation facility provider shall, when they have passed the inspection under the paragraph 1, fix the activation date and report it to the Minister of Transport.
4. The aerodrome provider or the air navigation facility provider shall not activate the facility concerned for public use before the activation date as submitted in accordance with the provisions of the preceding paragraph.
(Alteration of Aerodromes or Air Navigation Facilities)
Article 43. The aerodrome provider or the air navigation facility provider shall obtain permission from the Minister of Transport, when significant alterations are made to these facilities concerned for the purpose of securing air safety specified by Ordinances of the Ministry of Transport (including the case of relocating the reference point at the aerodrome).
2. The provisions of Article 38 paragraph 2 through 4 inclusive, Article 39, Article 40 and the preceding Article shall apply accordingly to the case of the preceding paragraph. However, the provisions of Article 38 paragraph 3, Article 39 paragraph 2 and Article 40 shall apply accordingly only when there are any alterations to the extent, approach surface, transitional surface or horizontal surface of the aerodrome.
(Deactivation or Closure of Aerodromes)
Article 44. The provider of an aerodrome for public use shall, in the case of deactivation or closure of the said aerodrome, obtain permission from the Minister of Transport.
2. The Minister of Transport shall, in the case there has been an application for permission under the preceding paragraph, permit the application thereof, except under recognition of the fact that deactivation or closure of the said
