(Qualifications for Competence Certification)
Article 26. No person may be issued a certificate unless he is of such age and has such flight and other aeronautical experience, as specified by Ordinances of the Minister of Transport, according to each qualification listed in Article 24 and each category of aircraft under the prevision of paragraph 1 of the preceding Article.

 

2. No person may be issued a competence certificate as a flight radio operator unless he has been licensed in accordance with Article 41 paragraph 1 of the Radio Regulatory Law (Law No. 131 of 1950) with respect to such qualifications as a radio man under Article 40 paragraph 1 of the same Law as specified by Ordinances of the Ministry of Transport and unless he has complied with the provision of the preceding paragraph.

 

(Criterion for Eligibility, etc.)
Article 27. No person whose competence certificate has been revoked in accordance with the provisions of Article 30 is eligible to make an application for a competence certificate for a period of two years after the date of that revocation.

 

2. The Minister of Transport may, within a period of two years, reject an application for a competence certificate for a person who has committed a dishonest act in the examination under paragraph 1 of Article 29.

 

(Privileges)
Article 28. No person shall perform the duties listed in the “Privileges” column of the attached table unless he holds a competence certificate (for a person who is engaged in aircraft operations on board aircraft the competence certificate listed in the “Qualifications” column of the said table must be accompanied by an aviation medical certificate under paragraph 1 of Article 31).
However, the same shall not apply where the person, who has competence with regard to the qualification as an airline transport pilot, commercial pilot, private pilot, first class flight navigator, second class flight navigator or flight engineer who operates radio equipment for receiving purposes only and also where the person, who holds the qualifications of radio man under paragraph 1 of Article 40 of the Radio Regulatory Law, operates radio equipment in accordance with paragraph 2 of the said Article.

 

2. No airman, whose competence certificate has ratings under Article 25, may perform the duties listed in the "Privileges" column of the attached table except with respect to the aircraft for which an aircraft category rating, class rating or type rating has been assigned, or the functions for which a rating has been assigned.
